COOFANDY TERMS OF SERVICE

These Terms of Service (“Terms”) govern access to and use of https://www.coofandy.in/ (“Website”) and purchases made through the Website. Coofandy is a brand owned and operated by DG CREATION, a sole proprietorship registered in India.

In these Terms, “Coofandy”, “DG CREATION”, “we”, “us” and “our” refer to DG CREATION. “Customer”, “user”, “you” and “your” refer to the person accessing the Website or placing an order.
1. Acceptance of these Terms
By accessing the Website, creating an account, using guest checkout or placing an order, you agree to these Terms and the policies referred to in them. If you do not agree, do not use the Website or place an order.
These Terms are subject to applicable Indian law. Nothing in them removes or limits a consumer right that cannot legally be excluded.
2. Eligibility and minors
You must be legally capable of entering into a binding contract. A person under 18 years of age may use the Website or place an order only under the supervision of, and with consent from, a parent or lawful guardian. The parent or guardian accepts responsibility for the minor’s Website use and order.
3. Accounts and guest checkout
Guest checkout is available. Where an account feature is used, you must provide accurate information and keep your login credentials confidential. You are responsible for activity under your account unless caused by our failure to use reasonable security measures.
We may suspend an account or restrict use where we reasonably suspect fraud, unauthorised access, abusive activity or violation of these Terms.
4. Product information and availability
We make reasonable efforts to describe products accurately. Product images are illustrative, and colours may vary slightly because of photography, lighting, screen settings, device displays and manufacturing variations.
Measurements may vary within reasonable manufacturing tolerances. Customers should review product details, material information and size charts before ordering. Size exchanges are not available after delivery.
All products are subject to availability. Display of a product does not guarantee that it will remain available or that an order will be accepted.
5. Prices, taxes and errors
Prices are displayed in Indian Rupees unless stated otherwise. Applicable taxes are included or disclosed in accordance with the Website and checkout presentation.
DG CREATION may correct a pricing, description, discount, inventory or technical error and may reject or cancel an affected order. If payment has already been collected for an order cancelled by DG CREATION, the applicable amount will be refunded.
6. Orders and acceptance
Submitting an order is an offer to purchase. An automated acknowledgement does not necessarily constitute final acceptance. DG CREATION may verify customer details, payment, COD intent, address serviceability and stock before confirming or dispatching an order.
We may limit quantities or refuse, hold or cancel an order for stock issues, pricing errors, suspected fraud, failed payment, incomplete information, abusive conduct, unusual bulk or resale activity, courier limitations or another lawful operational reason.
If we cancel a prepaid order, the refund will be processed according to the Cancellation Policy and applicable law.
7. Payments
Available payment options may include Razorpay-supported online payments and cash on delivery for serviceable locations. Payment options may change without notice.
Online payment credentials are processed by authorised payment providers. Customers must not use an unauthorised, fraudulent or unlawfully obtained payment method. DG CREATION may request reasonable verification before accepting or fulfilling a transaction.
8. Order confirmation, cancellation and changes
Customers may request cancellation before order confirmation by calling or messaging +91 74900 06066 on WhatsApp. Customer cancellation is not available after confirmation, except where required by law.
Before dispatch, customers may request a size, colour, address or phone-number correction. Changes are subject to availability and operational feasibility and are not guaranteed. Full details are in the Cancellation Policy.
9. Shipping and delivery
We currently deliver only within India to courier-serviceable PIN codes. Orders are normally processed within 1 to 2 business days, and estimated delivery after dispatch is 3 to 7 business days. These are estimates, not guarantees.
Shipping is currently free for eligible Website orders. COD is available for serviceable locations. Delivery is facilitated through Shiprocket and courier partners within its network. Customers must provide accurate address and contact information and reasonably cooperate with delivery attempts.
A ₹200 charge per shipment may apply to re-shipping or customer-caused return-to-origin shipments, including refusal, an incorrect address or customer unavailability. Full details are in the Shipping Policy.
10. Returns, refunds and exchanges
Eligible regular-priced products may be returned within 7 calendar days of delivery, subject to the Return, Refund and Exchange Policy. Sale, discounted, combo, bundle, clearance and innerwear products are not returnable or exchangeable, except where applicable law provides a remedy for a damaged, defective, incorrect or misdescribed product.
Size exchanges are not available. Exchanges are limited to verified damaged, defective or incorrectly supplied products. Such claims must be reported within 3 calendar days with the required photographs and continuous unboxing video.
A ₹200 reverse-logistics charge per shipment applies to an eligible customer-reason return. Approved refunds are initiated within 7 business days after receipt, inspection and approval of the returned product.
11. Offers, promotions and discount codes
Discount codes, combo offers, bundles, gifts, limited-time promotions and other offers may have separate eligibility, duration, product, quantity, payment or usage conditions. Unless expressly stated otherwise:
• Offers cannot be exchanged for cash;
• Discount codes cannot be combined;
• An offer may be limited, modified or withdrawn before an order is placed;
• Misuse, duplicate use or fraudulent participation may result in cancellation; and
• Sale, discounted and combo products are governed by the return restrictions stated above.
Any material conditions will be displayed or made available with the relevant offer.
12. Permitted and prohibited use
You may use the Website only for lawful personal shopping and related purposes. You must not:
• Violate applicable law or another person’s rights;
• Submit false, misleading, fraudulent or incomplete information;
• Interfere with Website security, operation or availability;
• Introduce malicious code, scrape the Website without permission, or attempt unauthorised access;
• Impersonate another person or use an unauthorised payment method;
• Abuse staff, delivery personnel or customer-support channels; or
• Reproduce or commercially exploit Website content without permission.
13. Intellectual property
The Coofandy name, Website design, text, graphics, photographs, logos, product presentation and other content are owned by or licensed to DG CREATION and are protected by applicable intellectual-property law. No licence is granted except the limited right to access and use the Website for lawful personal purposes.
14. Reviews and customer content
If you submit a review, image, feedback or other content, you confirm that you have the right to provide it and that it is accurate, lawful and does not violate another person’s rights. You grant DG CREATION a non-exclusive, royalty-free right to use, reproduce and display that content for operating, improving and promoting Coofandy, subject to applicable privacy law.
We may remove unlawful, abusive, fraudulent, irrelevant or rights-infringing content.
15. Third-party services and links
The Website may rely on or link to third-party services, including Shopify, FastRR, Shiprocket, Razorpay, Meta, Google and courier partners. Their services may be governed by separate terms and privacy policies. DG CREATION is not responsible for a third party’s independent acts or content, except to the extent responsibility cannot legally be excluded.
16. Disclaimer and limitation of liability
The Website is provided on an “as available” basis. We do not guarantee uninterrupted or error-free availability, but this does not affect mandatory consumer guarantees or remedies.
To the maximum extent permitted by law, DG CREATION will not be liable for indirect, incidental or consequential loss that was not reasonably foreseeable and was not caused by our breach of a legal duty. Nothing in these Terms excludes liability for fraud, wilful misconduct, defective products where liability is imposed by law, or any other liability or consumer remedy that cannot lawfully be excluded.
17. Indemnity
To the extent permitted by law, you agree to be responsible for losses reasonably suffered by DG CREATION because of your unlawful use of the Website, fraud, infringement of another person’s rights or material breach of these Terms. This clause does not apply to losses caused by DG CREATION or remove statutory consumer rights.
18. Privacy
Personal data is handled according to the Coofandy Privacy Policy and applicable Indian law. By providing information, you confirm that it is accurate and that you are authorised to provide it.
19. Changes to the Website and Terms
We may update the Website, policies or these Terms for operational, commercial, security or legal reasons. Revised Terms will be posted with an updated effective date and will apply prospectively. Terms applicable when an order was placed will continue to govern that order unless a legal change requires otherwise.
20. Governing law and dispute resolution
These Terms are governed by the laws of India.
Before commencing court proceedings, the customer and DG CREATION should first attempt in good faith to resolve the dispute through written communication for 30 days after a detailed complaint is received. This informal process does not prevent either party from seeking urgent relief and does not restrict a consumer’s right to approach a competent Consumer Commission or other statutory authority.
Subject to mandatory consumer-protection jurisdiction and other applicable law, courts at Surat, Gujarat will have exclusive jurisdiction over disputes arising from the Website, an order or these Terms.
21. Severability and waiver
If any provision of these Terms is held invalid or unenforceable, it will be limited or removed only to the minimum extent required, and the remaining provisions will continue in effect. A delay in enforcing a right is not a waiver of that right.

Customer grievances will be acknowledged within 48 hours and handled within one month from receipt, in accordance with applicable law.
